REGULAR MEETING
ASHLAND CITY COUNCIL
JULY 17, 2006
The Ashland City Council met for a regular meeting on July 17, 2006 at 5:00 P.M. in the Ashland City Hall Auditorium with Mayor Terry Turner presiding. Council Members present were Zeola D. Echols, Bobbie J. Steed, Gail E. Thompson, Rebecca G. Boddie and Mike Beale. Also present was City Attorney John K. Johnson, City Clerk Charles E. Foster, Assistant City Clerk Donna J. Bennett, Police Chief Derrick Forbes, Code Enforcement Officer Terry Raughton, Maintenance Supervisor Randy Hanners, Fire Chief Randy Mitchell, Chief of Police Derrick Forbes, Officer Jason Gentry, Dispatcher Randy Gidley and Ray Stansell of the Clay Times-Journal. Attendance roster attached.
Mayor Turner called the meeting to order and Council Member Thompson gave the invocation.
Council Member Thompson moved to approve the agenda with the following additions. Item No. 7 under New Business was added as - Purchase of new flags. Item No. 8 under New Business was added as - Opening of position of Senior Center Manager. Item No. 9 under New Business was added as - Clarification of Assistant Police Chief position as permanent or temporary and Item No. 10 under New Business was added as Municipal Vehicle Policy. Council Member Boddie seconded the motion to approve the agenda with the above-mentioned additions and all votes were unanimous.
Council Member Boddie moved to approve the minutes of the previous meeting. Motion was seconded by Council Member Steed and all votes were unanimous.
Under informational items, Mayor Turner announced that the Clay County Hospital Wellness Center would have a dedication ceremony on Sunday, July 23 at 2:00 P.M.
Under committee reports, Council Member Echols did not report.
Council Member Steed did not report.
Council Member Thompson extended her thanks to the Maintenance Department for their work around the square.
Council Member Boddie also added her thanks to the Maintenance Department. Council Member Boddie stated that even though it was not her department, she reported that the light at the skate park was out. She went on to report that the park had been damaged by vandals and asked that the Maintenance Department check on people shooting fireworks.

Council Member Beale reported that the Fire Department had received a price of $7499.00 on a used Chevrolet Tahoe to be used as a Chief car and asked that it be purchased out of their Department’s tax fund. Since this item was not on the agenda, Council Member Beale made a motion to suspend the rules and allow this item to be voted on. Due to the lack of a second, the motion died on the floor.
City Clerk Foster did not report.
Police Chief Forbes did not report.
Fire Chief Mitchell did not report.
Maintenance Supervisor Hanners did not report.
Code Enforcement Officer Raughton did not report.
Under new business, Council Member Thompson moved to approve the bills received since the last meeting in the amount of $5386.11. This motion was seconded by Council Member Echols and all votes were unanimous.
Council Member Beale made a motion allowing Officer Chris Mathews compensatory time at a rate of one and one-half time while he was serving in the position of Chief of Police. Hours are accrued over the regular eighty hours scheduled in a two-week pay period. Council Member Boddie seconded this motion and all votes were unanimous.
Council Member Boddie made a motion to suspend the current policy concerning the payment of overtime to Supervisors and allow payment of overtime to Maintenance Supervisor Hanners for work done on the Courthouse Square after hours this pay period. This suspension of policy will be for the one time only. This motion was seconded by Council Member Thompson and all votes were unanimous.
Council Member Boddie made a motion to table a decision on the reappointment of Council Member Beale to the Water Works & Sewer Board until information can be obtained concerning the legality of the appointment. This motion was seconded by Council Member Steed and all votes were unanimous.
Council Member Thompson made a motion to reduce the cost for purchases without prior Council approval from $750.00 to $250.00. This motion was seconded by Council Member Echols. Upon voting, all members voted yea except Council Member Beale who voted nay. Motion carried.
Council Member Beale made a motion to donate one 1992 Ford F250 Pickup, VIN 1FTHF25H3NNA23794 to the Clay County Board of Education bus shop. This motion was seconded by Council Member Thompson and all votes were unanimous.

Council Member Boddie made a motion to purchase ten more flags, poles and brackets to be placed around the square. This motion was seconded by Council Member Beale and all votes were unanimous.
Council Member Thompson made a motion to open the position of Senior Center Manager with the position to be advertised for four weeks. City Clerk Foster will obtain the job description, pay rate/range from the approved JSU compensation plan. This motion was seconded by Council Member Steed and all votes were unanimous.
Council Member Beale made a motion to clarify the position of Assistant Police Chief as permanent. Motion died for lack of a second.
Council Member Steed made a motion to clarify the position of Assistant Police Chief as temporary until the return of Police Chief Forbes from his ten weeks of school. This motion was seconded by Council Member Echols and a roll call vote was taken.
Upon call Council Member Echols voted yea, Council Member Steed voted yea, Council Member Thompson voted yea, Council Member Boddie voted yea, Council Member Beale voting Nay and Mayor Turner voting yea. Motion carried.
No action was taken on Item No. 10 under New Business.
Under old business, much discussion was held on the taxing or regulations for sweepstakes businesses and business license(s) required for this business. No action was taken at this time.
Council Member Echols made a motion not to accept the resignation of Officer Cecil Chappell from the Police Department. This motion was seconded by Council Member Thompson. Mayor Turner asked for a roll call vote. Upon call Council Member Echols voted yea, Council Member Steed voted yea, Council Member Thompson voted yea, Council Member Boddie voted yea and Mayor Turner voted yea. Council Member Beale abstained. Motion carried.
It was asked by Council Member Beale if Officer Chappell would be disciplined. It was stated by City Attorney Johnson that it was the discretion of Chief Forbes to discipline Officer Chappell per the Disciplinary Policy and Procedure of the Ashland Police Department that was approved in 2002.
There being no further business, Council Member Boddie made a move to adjourn. This motion was seconded by Council Member Echols and all votes were unanimous.
